User Agreement

Please read this Service Agreement (hereinafter referred to as the "Agreement") carefully before registering for "Hangzhou Jinri Xin Hua Network Technology Co., Ltd." Ensure that you fully understand the terms of this Agreement. Please read carefully and choose whether to accept or reject this Agreement. Unless you accept all the terms of this Agreement, you are not authorized to register, log in, or use the services covered by this Agreement. Your actions of registration, login, and use will be deemed as acceptance of this Agreement and agreement to be bound by all the terms herein. This Agreement sets forth the rights and obligations between us and the users regarding the App software services (hereinafter referred to as "Services"). A user refers to an individual or organization that registers, logs in, and uses these services. We may update this Agreement at any time. Once the updated Agreement is published, it will replace the previous version without further notice. You can review the latest version of the Agreement within the App. After the Agreement is amended, if you do not accept the modified terms, please cease using the services provided by us immediately. Your continued use of our services will be regarded as acceptance of the modified Agreement.

If you are a minor or have not reached the legal age of consent, you must read this Agreement under the supervision of your parents or legal guardians. Acceptance of this Agreement is considered as having obtained the approval of your parents or legal guardians.

1. Account Registration

  1. Before using our services, users are required to register an App account. The App account should be registered and bound with a mobile phone number or email address. Please use a phone number that has not been bound to an App account and has not been banned by us. We may change the methods of account registration and binding according to user needs or product requirements without prior notice.
  2. In view of the account binding and registration method of this App, you agree that your mobile phone number and mobile device identification code will be used for registration when you register for this App.
  3. When you register and use our services, we need to collect personal information that can identify your identity so that we can contact you when necessary or provide you with a better user experience. The information we collect includes but is not limited to your name and address. We agree that the use of this information will be subject to the constraints of Article 3 on the protection of user personal privacy information.

2. Protection of User Personal Privacy Information

  1. If we discover or receive reports or complaints from others that a user has violated the terms of this Agreement, we have the right to review and delete relevant content, including but not limited to user information and posting records, at any time without notice, and to impose penalties on the offending account, including but not limited to warnings, account bans, device bans, and function bans, and to notify the user of the handling results.
  2. Users who are banned for violating the user agreement may contact us on their own. Users who have been subject to functional bans will have their banned functions automatically restored upon the expiration of the ban period. Banned users may submit appeals, which we will review and make reasonable judgments to decide whether to change the penalty measures.
  3. Users understand and agree that we have the right to impose penalties on behaviors that violate relevant laws and regulations or the provisions of this Agreement, to take appropriate legal actions against any user who violates the law, and to preserve relevant information and report to the competent authorities in accordance with laws and regulations. Users shall bear all legal liabilities arising therefrom.
  4. Users understand and agree that if a user violates the terms of this Agreement, resulting in or causing any claims, demands, or losses asserted by any third party, including reasonable attorney's fees, the user shall compensate us and our cooperating companies and related companies and hold them harmless.

3. User Content Posting Standards

  1. The content referred to in this Article means any content created, uploaded, copied, published, and disseminated by users during the use of this App, including but not limited to avatar, name, user description, and other registration information and certification materials, or text, voice, images, videos, graphics, and other messages sent, replied to, or automatically replied to, as well as related link pages and other content generated by using the account or this service.
  2. Users shall not use the App account or this service to create, upload, copy, publish, or disseminate the following content prohibited by laws, regulations, and policies:
    1. Opposing the basic principles established by the Constitution;
    2. Endangering national security, disclosing state secrets, subverting state power, and undermining national unity;
    3. Damaging the honor and interests of the state;
    4. Inciting ethnic hatred and discrimination, and undermining ethnic unity;
    5. Violating national religious policies, promoting cults and feudal superstitions;
    6. Spreading rumors, disturbing social order, and undermining social stability;
    7. Spreading obscene, pornographic, gambling, violent, murderous, terrorist, or criminal-inciting content;
    8. Insulting or defaming others, infringing upon the lawful rights and interests of others;
    9. Containing other content prohibited by laws and administrative regulations.
  3. Users shall not use the App account or this service to create, upload, copy, publish, or disseminate the following content that interferes with the normal operation of the App and infringes upon the lawful rights and interests of other users or third parties:
    1. Containing any sexual or sexually suggestive content;
    2. Containing content with insults, threats, or intimidation;
    3. Containing harassing, spam, malicious information, or fraudulent information;
    4. Involving the privacy, personal information, or data of others;
    5. Infringing upon the lawful rights of others, such as reputation rights, portrait rights, intellectual property rights, trade secrets, etc.;
    6. Containing other information that interferes with the normal operation of this service and infringes upon the lawful rights and interests of other users or third parties.

4. Usage Rules

  1. Any content transmitted or published by users in or through this service does not reflect or represent, nor shall it be deemed to reflect or represent, our views, positions, or policies. We shall not be liable for any of the content.
  2. Users shall not use the App account or this service to engage in the following behaviors:
    1. Submitting or publishing false information, or impersonating others by using their avatars or information;
    2. Forcing or inducing other users to follow, click on links, or share information;
    3. Fabricating facts or concealing the truth to mislead or deceive others;
    4. Using technical means to create a large number of fake accounts;
    5. Engaging in any criminal activities using the App account or this service;
    6. Creating, publishing methods or tools related to the above behaviors, or operating or disseminating such methods or tools, whether for commercial purposes or not;
    7. Any other behavior that violates laws and regulations, infringes upon the lawful rights and interests of other users, interferes with the normal operation of the App, or is not expressly authorized by us.
  3. Users are fully responsible for the authenticity, legality, harmlessness, accuracy, and effectiveness of the information transmitted using the App account or this service. Users shall bear all legal liabilities related to the information they disseminate. If any damage is caused to us or a third party as a result, users shall compensate in accordance with the law.
  4. The services we provide may include advertisements. Users agree to display advertisements from us and third-party suppliers and partners during the use of the services. Except as expressly provided by laws and regulations, users shall be responsible for any transactions made based on such advertisements. We shall not be liable for any losses or damages suffered by users due to transactions based on such advertisements or the content provided by the advertisers.

5. Miscellaneous

  1. We hereby solemnly remind users to pay attention to the terms in this Agreement that exempt us from liability and restrict users' rights. Please read carefully and consider the risks. Minors should read this Agreement under the accompaniment of their legal guardians.
  2. The validity, interpretation, and resolution of disputes of this Agreement shall be governed by the laws of the People's Republic of China. If any dispute or controversy arises between users and us, it should first be resolved through friendly consultation. If no agreement can be reached through consultation, users agree to submit the dispute or controversy to the competent people's court at our domicile.
  3. If any term of this Agreement is invalid or unenforceable for any reason, the remaining terms shall still be valid and binding on both parties.
  4. We retain the final interpretation rights of this Agreement. According to Apple's disclaimer, we hereby declare that the registration and user agreement of this App are not related to Apple Inc.
